Mobio Technologies Inc. and its licensors (collectively, "Mobio") own, operate and/or provide access to certain software and related services, including the website located at www.mobio.net (collectively, the "Services"). This policy applies to all Mobio Services.
Questions about our Services, or regarding your rights and responsibilities under this Policy can be directed to firstname.lastname@example.org, or via post to 250 - 375 Water Street, Vancouver, British Columbia, Canada V6B 5C6. If there are any provisions you do not agree with, that you can’t comply with, or that you don’t understand, you may not use Mobio’s Services.
We are committed to implementing technology designed to give you a powerful and safe online experience. This Policy explains what information, including personal information, we obtain from you in your use of our services, and the steps we take to secure that information. This Policy also explains how you can contact us if you have a question about our privacy practices.
In this Policy, "personal information" means information about you as an identifiable individual.
By submitting information to us, or indicating your acceptance of legal agreements with us, or by otherwise using any Mobio service, you consent to the collection, use and disclosure of your information, including your personal information, in accordance with this Policy. We will not collect, use or disclose your personal information in a way that is incompatible with applicable legislation or this Policy.
We recommend that you take the time to read this Policy so that you understand how we handle information. As we develop and expand our services, this Policy may also change. We will include a "last revised" date on the Policy as displayed on the Website. We strongly encourage you to refer back to the Policy periodically.
1. How We Collect and Use Personal Information
Account information – personal information requested
For most users, we ask for and store personal information when creating an account via our software to access our related Services—specifically, your name, email address and your password. We use this information to create your account, and to allow administration of it.
For example, we may use your name and email address to answer queries you may send to us, and to communicate with you when necessary concerning the administration of your account and the processing of your requests. As these functions are necessary to the proper administration of your subscription, we do not offer an opt-out from providing your name and email address for such communications.
You can change this information from within the software application, by visiting the "Profile" page.
Account information – no personal information requested
For other users, we do not ask you to provide any personal information at the time you open an account with us. In these cases, we are not collecting any personal information from you.
Additionally, when you visit our Website or Service, a cookie may be placed within the memory of your internet access device. A cookie is a small piece of information that can be stored for later retrieval. We may use permanent cookies or server-side artefacts to help us track use of our Services by users and visitors, such as the number and frequency of visits to our pages and which parts of our website are visited. We do not use any personal information while generating this information, nor do we relate any of this information to an individual member or user.
Other Purposes and Technical Data
Further, you agree that we may collect and use technical data and related information, including but not limited to technical information about your device, system and application software, and peripherals gathered periodically, to facilitate the provision of software updates and product support, to allow us to improve our products, and to provide services or technologies to you. We do not use any personal information while generating this information, nor do we relate any of this information to an individual member or user.
2. Our Disclosure of Personal Information
We do not share or disclose your personal information, other than as outlined below, unless you specifically provide us with your opted-in permission to do so. The delivery of an offer to you does not mean that personal information about you has been disclosed to the provider of the offer.
We may disclose personal information if a law, regulation, search warrant, subpoena or court order legally requires or authorizes us to do so. We may also disclose personal information if we believe that doing so is reasonably necessary or appropriate to protect the rights, property, or safety of Mobio, our users, our employees, copyright owners, third parties or the public, including without limitation to protect Mobio or our users from fraudulent, abusive, inappropriate, or unlawful use of our Services. Additionally, we reserve the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal or financing of all or any portion of Mobio or of any of the business or assets or shares of Mobio, provided that the third party represents that it will continue to use the information for the purposes set out in this Policy and in accordance with applicable privacy protection laws.
We may share your information, other than your personal information, with our third party partners to allow both us and them to provide and improve our product and service offerings to you.
3. Retention of Your Personal Information
We retain your personal information and related information for the period that you remain a user of our Services. Subsequent to the termination of our business relationship with you, we will take steps to remove all of your personal information from our production servers; however, personal information may be stored in our archives as permitted and required by applicable laws.
4. How We Protect Your Personal Information
We use reasonable and appropriate measures designed to help secure your information against accidental or unlawful loss, access or disclosure. Only staff and service providers who have a legitimate business purpose for accessing your personal information collected by us are authorized to do so. Unauthorized use of personal information by anyone affiliated with Mobio is prohibited and constitutes grounds for disciplinary action.
5. Updating Your Personal Information
You are required to ensure the personal information you provide to us is true, accurate, current and complete, and to maintain it as such. You can update your personal information by accessing the "Profile" tab of the software.
6. Links to Third Party Sites
The use of our Services may lead you to third party websites: for example, we may provide you with an opportunity to make a discounted purchase at a third party website. Such organizations are separate and distinct from Mobio, and have their own separate privacy policies.
We are not responsible for how any third party collects, uses or discloses your personal information—so it is important to familiarize yourself with the privacy policies of these websites before providing your personal information to them.
7. Contacting Us
In the event that you have any questions about this Policy or if you have reason to believe that we may have failed to adhere to it, please contact us by sending an email to email@example.com.
